    There is good news in this case.

    Marine vet Daniel Penny’s GiveSendGo legal defense fund is site’s second-biggest campaign.

    Lawyers for Penny, who is charged in the subway chokehold death of Jordan Neely, have raised over $2.6 million on GiveSendGo.

    Will it help against DA Bragg's stacked deck ? Too bad some of the donors will not be sitting in the jury.

    Bragg is also hard at work hunting down the other 2 Good Samaritans .
    Lefty DAs are hard at work decriminalizing crime. So they have to come up with new crimes to justify their existence. Being a Good Samaritan and self defense are 2 of the new crimes.

    I don't think Penny will do well at the initial trial, but once it works its way up the chain of appeals, he will prevail. It will be a long, expensive process, so it's good he has a significant war chest.

    Once convicted ,appeal or not ,he will serve jail time. Riker's Island is a terrible place to await an appeal.

    Penny was indicted for 2nd degree manslaughter .

    Penny was not arrested until Bragg was sufficiently pressured by professional activists .

    Daniel Penny's trial begins today. It will be held in the same court house where Alvin Bragg got Trump convicted . Bragg is prosecuting this case too . The timing of the trial is curious given that it is in the final weeks of the elections where crime is a big issue. Is this the Dems trying to show a tough on crime posture ?
    But that could backfire as Penny could be a sympathetic martyr and hero .

    The defense rested yesterday. Penny did not testify. This was the 2nd high profile trial this week . In the other one Jose Antonio Ibarra was found guilty of the murder of Laken Riley.

    Riley was defenseless against a predator. Penny is charged for stepping up and protecting the defenseless.

    Not entirely sure what I think about Penny. Was it necessary for him to kill the guy? That's the big question.

    At any rate, he seems to be on a course to acquittal. Even Bragg's prosecution has backfired.

    But a host of prosecution witnesses, Penny’s fellow passengers, knocked massive holes in that tale, as one after another veteran subway rider described how terror-stricken they were trapped on the train car with the angry, unstable, threatening Neely.
    One woman said she “was scared s–tless” by Neely’s behavior and recalled him yelling: “I don’t give a damn. I will kill a motherf—–r. I’m ready to die.”

    The question is if the submission hold was a choke hold. Testimony by a defense pathologist stated that Neely had medical conditions and synthetic marijuana that could've contributed to his death. A combat instructor testified that the hold's purpose is to knock someone out without killing them . Police detected a pulse when they arrived .

    Very true. Her case is a puzzle of sorts. As I understand it, she was on a public trail and tried to attract some attention to her situation. And if we want to wonder what has happened to men these days, you need look no further than Penny's case.

    He is talking out of both sides of his mouth, trying to appear supportive of Penny without suggesting he should be found innocent. And as you pointed out, when the mayor is critical of the mental health system of NYC, then he is really being critical of himself. Maybe they could take some of that money they are using to house, feed, and entertain illegals and use it to take care of mentally ill New Yorkers.

    Even in NYC, justice can still prevail. Penny was found not guilty, but the very fact that these silly charges were even brought against him will send a chilling message to any other person considering trying to do the right thing and help another person being threatened.
