    New York Withholding Tax
    Hello!

    I have a couple of questions for New York Accounting that the NY Department of Taxation cannot answer without having to call them which is not an option for me.

    Can anyone here please explain to me the different payment frequencies for withholding tax in New York? Thanks!

    Are you asking how often, as an employer, you have to send withholding to the Tax authority? I'm pretty sure it's a minimum of quarterly. Don't you use a payroll service? They should handle that for you.

    They decide frequency, based on your payroll. You do have to contact them, even if it isn't by phone.
    Generally a small company will be either monthly or quarterly. VERY small to be allowed quarterly, such as 2 or 3 employees. It depends, it depends.

    Payroll Tax in New York
    Are there any NY accountants here that can explain to me which taxes and which forms are used by employers in New York that are related to payroll only?

    You HAVE to call the IRS to get an EIN. Then you HAVE to call the state to tell them the EIN and get sent a package of forms, with instructions.
    Unless things have changed in recent years....

    I'm concerned that the 'calling is not an option' means that something is going on with undocumented workers.
    I answered why there are no exact answers yesterday.

    I live in a different country from the US and I am currently doing research for the different tax jurisdictions. Some states don't have very detailed tax guides and I can't really call because calling to the US from a different country is quite expensive.

    Something about your questions sounds implausible, but here's the story from years ago, when I did payroll for small businesses without a payroll service.
    You don't get to just ask for forms. You have to get an EIN first (employer id number). You get it from the feds and you use it for the state.
    You then contact the state with the EIN and they ask you questions about your company.
    Based on that information, they calculate how often you remit taxes, and submit various reports.
    I don't know the formula. I imagine it changes. It includes size of company, number of employees, pay period (weekly, bimonthly, monthly) and size of payroll.
    Usually you will report monthly. One or two or three employees, possibly quarterly.
    You will also have to pay UI, and that changes often too. I have worked in periods of high unemployment when the tax was surcharged retroactively!
    The state needs to know that you have a business license, liability insurance, and WC (workmen's comp) too...
    AND that fly by night employers aren't withholding $$$ from pay and not sending it in!
    I'm not going to go on and on about this.
    Ask for a different 'assignment'.....
