    I am being sued my MBNA
    I am with a debt consolidation company and have been for over a year. MBNA is the account that I am using them for. I was served today with a court order to appear because they are suing for the full amount. I can not possible pay this which is why I went with the consolidation service. The interest rate was so high I could make the payments. I have to bring my checkbook, saving book, mortgage information etc. I can not afford to have my wages garnished as we live off my paycheck. I am very worried that they will take the money we have in the savings which was our tax refund. This is all we have to get us through any unexpected expensives that come up. Its not much just
    2200.00. Can they take this money and our property?

    About how much do you owe them? Would this tax refund money cover or greatly reduce the amount owed to mbna? Look at your interest rate on your credit account that you are paying.. It is much higher than any interest rate you are getting on your savings account. If the case makes it to court then they can take what is owed to them, whether it is from freezing your accounts, taking your pay, or seizing your property. If the court seizes your property they will auction it for whatever they can, not give you what it is worth. Remember this is probably the biggest "unexpected exspense" that you will encounter. It doesn't sound like your consolidation service is really a credit counselor, is it? You should bring your finances to a local non-profit credit counselor and let them look at the specifics of your finances. If you can't get it worked out, you may have to file for bankruptcy to keep them from taking your wages, belongings, and possibly your home if you own one. Remember bankruptcy is a last resort. It will stay on your credit report for years and can affect anything from getting a loan or getting a job. Please talk to a NON PROFIT COUNSELOR as soon as possible.
