    Is is legal for a temporary guardian to take baby out of state with out asking birth mother?

    My daughter is 15 and didn't get a chance to prove if she was able to take care of her baby, she is very disrespectful to me and now a friend of ours has temporary guardianship of my grandson and I am very confused at to what rights we still have,, the guardian took him to FLA., we live in Ma., Is that legal ? For her not even to ask my daughter ?

    Even if it is not legal, or if it is legal, you are going to have to address this in court. You will have to go back to the court who issued the temp guardianship and try to have it overturned.

    I assume you are the grandmother, your daughter who is 15 has a baby ( and I hope the father is in jail for having sex with either a 14 or 15 year old) but your grandchild had the custody given to someone else. You did not say what that relation of that person was.

    I can't see why this would not be legal, unless there was something specific in custody order. I would be looking closely at the issues the court had and trying to solve those, so that the mother can gain custody back.

    It sounds like temporary guardianship was given by a judge through child welfare?? If this is the case... as long as case worker has agreed it's OK. Is this out of state trip a visit or potential move? What has your daughter been allowed in terms of visitation? And why weren't you considered for guardianship of the child before anyone else? All of this bears upon the case. I would strenuously object via talking with case worker, talking with anyone involved in case to get things turned around as soon as possible. There may be certain steps already set by the court/case worker as to what you have to do to get child back. Do it all, to the letter, as soon as humanly possible. Do whatever you can to get child welfare out of your life as soon as possible is my best advice to you. Of course, most of this is based on what I have seen to be the most common reasons leading to your/your daughter's situation. If I am wrong... I truly beg your forgiveness. Good luck. Cathy

    If they have custody they can take the child where ever when ever... but they can not move without going to court and getting the judges permission!
