Probation Violation
Hello You guys , My Husband Was arrested sept 2 for VOP ( He was ID by the Police) His Original charge was Less than an oz ( weed ) He was sentence to probation for 12 months And fine was 1000. Its been 6 months and he haven't reported . He been sitting for 3 weeks now and his court date coming up , what to expect? This his first weed charge and first time on probation , he has a job now and willing to pay his fines and cooperate since he has the money to do so... he has proof of his job and he in school... he is not a trouble maker or anthing in that nature just was caught at the wrong place and wrong time... can some relate and help me please

Your post is really hard to understand. Let me try to simplify.
He was caught with weed, was arrested, was given probation, and then he was once again caught with weed, and is not in jail because of probation violation? Is that it?
If I got that wrong, could you please rewrite your post so it's clearer. No need to shorten sentences, to write in shorthand. Tell the story, write as much info as you have, the more the better. No limit here.

He was caught with weed in nov 2013 , went to court in feb 2014 and was giving probation for 12 months (Fine was 1000) He never reported to probation. He felt as if he didn't have the money they were going to lock him up anyway but now he has a job he willing to pay basically

Warrant for failure to appear
The Police ID my boyfriend and he had a warrant out for his arrest for not reporting to his p.o so he was detained. He was placed on probation back in feb 2014 - for less than oz charge (weed) , He been sitting in Jail now for 3 weeks and his hearing this Friday. What to expect? This his first weed charge and first time on probation. He has a job and enrolled in school and he only 20 y.o. I Kno there is no reason to not to report but as he stated to me he felt since he didn't have the money for his fees they were going to lock him up anyway.

Never reported to probation - was arrested for warrant that was issued
What to expect ? There is no new charge against him Just arrested for the violation of probation for not reporting to probation. Less than oz of charge... First drug charge and first time on probation

He's probably going to jail for a period of time, probably his full sentence.
Funny that you make excuses as to why he didn't report and how he is an upstanding citizen with a job and going to school and how he was caught in the wrong place at the wrong time....well first, he got caught with weed...not really a big deal but they were decent enough to give him probation...so what does he do? He thumbs his nose at the court and decides not to go to probation using a lame excuse to make him and you feel better about it. That is the wrong place at the wrong time? He should have just followed through with probation and taken care of business. Now it doesn't really matter that this was his first time for being caught with weed...they gave him a break by giving him probation...now he proved to them that they made a mistake by going easy on him. He's probably going to be doing some time now.

He deserves to go to jail... he refused to show up at his PO office after he got probation... which was a slap on the wrist. Maybe after sitting in jail he will begin to grasp the seriousness of a courts order.
Sorry... he was given a chance... and a very, very light sentence... and he blew it off because he didn't feel like doing what he was required to do, and what he agreed to do.
Maybe if he'd lay off the drugs..he would be clear headed enough to see that he is now in a situation completely of his own making and he is completely responsible for. Nothing accidental so the wrong place at the wrong time analagy doesn't apply.....because THAT would have been accidental. This was intentional.
What can he expect? He can expect to get the jail time he might have gotten the first time if he had not been foolishly given probation. He might even get additional time for the second charge as well.
Funny how he apparently has money to buy more pot...but not pay his fines.
What he actually gets is up to the judge and the fact he thumbed his nose at their authority once already....they are very unlikely to be as forgiving to him this time. He better hope the judge wasn't having a bad day before his case comes up.

Yes, he will be lucky, very lucky, if they just let him back on probation, he was stupid, refusing to report, because they may revoke him, so he does not go, so they will be sure to revoke him. ( no logic there)
They can, give him the full 12 months in jail. Or release him, back on probation.
My guess, he will get one month to three month in jail, to get his attention.
