    Can I sue the bank?
    Please tell me if I can sue the bank for cashing a two party settlement check without my signature?

    Also when I found out of the signature fraud it was my attorney who signed it without my consent. Does the bank have in liability in this matter?

    It was signed by your attorney, who it sounds like, signed your name. So no, the bank is not liable. If your attorney did not have permission, you may sue the attorney. I you gave the attorney authority to act on your behalf, then there may not be anyone to sue.

    Often if this was a check, for collections, or for a law suit, the check goes to the attoreny, who gets his fee first, and then pays you.

    I'm a little confused here. You got a settlement from some lawsuit? And it was made out to you and some other party? And your attorney presented it to a bank and cashed it? Did you receive the proceeds do you? Did the attorney take out money you owed him?

    More details might help us.
