    Probation violation.
    My son was on probation here in SA but he has now been violated. He got caught for DWI first time. What happens now?

    Court at a minimum... Serious legal fees and fines on the DWI part alone (in some places that's a year in jail on its own). The rest depends on what the probation was for, and what they would have gotten if they had not had probation.

    Will he do the whole year his probation was for drugs they have gave him 5yr but he was doing good until the problem with the separation of his wife

    That's up to the judge... a DWI is a serious violation. I would not expect them to go easy on them for either that or the Probation violation.

    At this point, he will remain in jail till there is a hearing on his probation.

    He will have to answer to the judge and show reason why he should remain on probation.

    He may be one week to six weeks waiting for that hearing.

    He needs to show that he has worked, had a regular job, was attending any required treatment or classes.

    He also, has to face court, for the DUI charges, this is separate from the probation, so he will have to deal with the DA and face fines, jail or a new probation for this.
