    Questions- : thift Under $5000
    Place Toronto Ontario.
    Charge : theft Under $5000
    Appearance date in court is in last week of April.

    I got the letter form someone to pay the damages occurred to the retailers ($475). Amount stolen was $ 175 and store recovered the stuff on the same day.
    Could someone please let me know what if I could not able to pay the amount by given date?
    I want to plead guilty on my first appearance. This is my first offence.. What would be my punishment.

    You will likely get probation but will need to pay the $450. What you stole did not include the legal expenses incurred by the store. They could have gotten for more.

    A quote from either site listed below:

    334. Except where otherwise provided by law, every one who commits theft
    (a) is guilty of an indictable offence and liable to imprisonment for a term not exceeding ten years, where the property stolen is a testamentary instrument or the value of what is stolen exceeds five thousand dollars; or
    (b) is guilty
    (I) of an indictable offence and is liable to imprisonment for a term not exceeding two years, or
    (ii) of an offence punishable on summary conviction,
    where the value of what is stolen does not exceed five thousand dollars.

    Don't care what you did, why, how you got caught... GET A LAWYER. Thinking the system will treat you kindly with a slap on the hand if your just honest and take your lumps can lead to many regrets. Not only fines, a criminal record, etc. Some states offer what's called a "diversion" program that allows you to pay your penance but not have a record... if it's a first offense. Anyway, many people in the system have been naïve and trusted in truth, honesty and been royally screwed. I'm sure it won't be as bad as your fears are however my strongest opinion is get a lawyer. Even if you have to borrow money... in the end you will be glad you did. Good luck. Cathy

    I got the same letter to pay (475)and the lawyer tall me to ignore it.
    But I'm not sure what to do, I went to court already and they give dervision agreement
    Form and no criminal record.
    And the other day I got this letter to pay damage but I'm not sure if I will pay,
    The lawyer tall me to ignore but I'm scared that the store will send me in court.
    Please someone help me I don't know what should I do.
