    No lease eviction
    I was behind on rent and the landlord told us to be out in a week... we moved in with our uncle in the guest house in the back because that was the most quick and closest place available in 1 week. First he attempted to raise his rent because we were living there. Then he stated he would not make any repairs that he promised to fix since he moved in 2 yrs prior, until we moved. Now he has posted a notice to vacate in 30 days due to breach of tenancy and there is no contract at all, let alone saying he can't have room mates. There are rats that have eaten my 1yr olds clothes with food droppings on them; electricity on one side of house does not work. We have to run extension cords across house to have power. The water just runs under the cabinets because the plumbing is incomplete from when he moved in and the hot water heater has never worked, because the gas does not work.

    So move if is so bad. You are going to have to anyway.

    He can evict you... you don't need to have a lease.

    Depending on how long you've been there , he might not have to give you any notice... you never told us how long you've been there. But he did give you thirty days...don't waste it.

    He can raise the rent every month if he wants, and you'll have to pay it... you don't have a lease. He can give you a 30 day notice to get out (which he has)..you don't have a lease, and you have to get out because when he goes to court to have it enforced... the Sherrifs will put you and all your stuff out at the street...


    Incidently...you do have a lease...its a 30 day lease assuming you've been there long enough to be considered a tenant. A guest can be thrown out at any time.

    First, Depending on location the landlord may have been within his rights to give you a pay or quit notice. This is a written notice that tells you to pay what you owe or move out in x days. The # of days he has to give you depends on local law.

    But this is moot since you did move.

    Now he wants your uncle out and it sounds like he may have grounds. Your uncle may have grounds to fight an eviction due to the lack of promised repairs.

    I'm glad you could read that scott... I didn't even begin to see that until I read it four times. Which of course would change things.
