    What can I do as a aunt, to get custody of my niece, me being on felony probation?
    My sister was sent to jail for probation violation and her husband about the same. I want to have my niece with me but I'm on felony probation for DWI. I'm in good standings with probation and my fees and start my classes soon. What can I do to have her with me? I'm the only one she wants to be with even over her mom. I kept her 4 to 5 nights a week, and have turned my life around. CPS got involved and they took her away from me. What can I do?

    First, any question on law needs to include your general location because laws vary by area. Next, I imagine she was taken from you because you are on probation. Was it something else? While what I am about to say isn't always my first suggestion but in your case it is. Find a lawyer to represent you. A judge has to rule in the best interest of the child. I'm not sure that you will be able to persuade a judge that after having both of her parents taken to jail being with an Aunt still on probation for a felony is in her best interest. Have you been sober for at least a couple years?
