Dad gone and shut out of everything by a non family member.
My dad just passed Saturday night, the man that looked over my dad has transferred all my dads property and assets into his name prior to my dads death, supposably so my dad could collect social security. Now I am whitnessing my dads belongings at the mans house that watched over my dad. No one called and told me my dad died and when informed I went directly to the funeral home yesterday to find the friend of my dads with my dads sister making arrangements for my dads funeral without me knowing. I am 38 years old and have been blocked from everything and would like to know why. I have no siblings to help me. Please let me know if I have any rights, my mom is flying in tomorrow with my dads last known will. My dad was very sick and Im concerned this man changed a lot I am unaware of.

My dad passed Saturday and the man watching over him has transferred all my dads assets and property in his own name. I don't know what to do, I am the only benificary and never was contacted when my dad died, then after finding out three hours later I showed up at the funeral home to find him there with my dads sister making arrangements without me. Iti is like I do not exist and all they say to me is they tried calling, you right. They never tried once.

First, my condolences on your loss.

Don't let them bully you! You are your dad's next of kin in most places (offspring come before siblings). So you take charge. Tell the Funeral Director you are taking charge. I would get an attorney and have an injunction placed against this person taking any belongings or assets from your father. Even if he had power of attorney, that expired with your dad's death.

As soon as you get a copy of the will, go to your local probate court and file it, then ask the court to appoint you executor unless another executor is mentioned. Having an attorney to guide you through this would be better. It appears this person is trying to loot the estate. So you need to fight him.
