    In New York state, my child is 20 and does not attend school. Can she receive child
    My daughter is 20 we both live in nys. She has a child of her own. Can she get child support from me?

    She wouldn't get child support from you even if there is an order to pay until 21. Her custodial parent would. If she is wanting help in raising her child she needs to get an order for support from the father of the child. If there is no current order stemming from when she was under 18 I don't see how her custodial parent could get one now. If you are wanting to help her with monetary gifts that are not ordered that is possible too. My parents, grandparents, aunts, and uncles were under no obligations to give me money when I was 20 and a starving college student but they did.

    Unless there is an order for you to pay you are not under any obligation either. This also includes any arrears from unpaid support from an order that 'used to be'. Once any of those arrears (if any) are caught up then the order is fulfilled.

    NYS law extends support until age 21. So you would have to continue paying as long as she is living with the custodial parent. However, if she is living on her own (or with the father), then you can petition the court to end the support order. But as long as that order stands you have to pay.

    If there is no current support order, I can't see the court awarding one at this point. But, as noted earlier, only her custodial parent can get support.
