I was convicted of 3 misdemeanors almost 5 years ago. My attorney did not want me to use first offender defense. He told me that we could back and go first offender later if we really wanted it. I received 3 years probation, commu nity service, and court costs. I finished early and have no other issues. I inquired about first offender the other day and he does not recall saying that. I missed getting job because of record. (I was 19 when plead guilty.) I would like record restriction if possible. Any suggestions? Thank you.

I am sorry for your troubles.

First if there were three separate charges, you can not use first offender. It is for one charge only.

Also it is not a defense, it is a plea agreement.

But no, you can not go back and plea it now, it is a plea you use at the time of trail or court hearing.

You can go back and ask for it to be explunged, but I think you have to be either 7 or 9 years past.
