    Need to Appear for a Felony Probation Viol in 2005-left country-what will happen now?
    About to appear after 8 years-of being outside the USA.

    In 2005 I was severely drug addicted with no way out of the mess I created...

    My original charge was FELONY Elder Abuse-I cashed checks for DRUG MONEY--

    My sentence was 180 days of weekends--but they were NEVER PERFORMED and then I left.

    My parent helped smuggle me over the border provided money for me fly to Russia. I worked, married and have 2 children there --STILL DRUG FREE, but when I went to consulate for new passport pages they detected me and sent me back to CALIF. W a one way passport back to the USA... to face the FELONY VIOLATION.

    I appear next MONDAY... Should I ask for jail time with NO TAIL (Probation) ?

    What can the judge sentence me to in this case?

    What is best case scenario for me and worst the judge sentence me to ?

    If I do not return to Russia in 90 days I will lose my employment -WORK VISA... and family-wife, children and my home (we bought a house)...

    Please advise..

    PS--I can not stay in USA or do 2-3 yr probation.. or there will be NO POINT in RETURNING... I am over 50 yrs old... and MY family depends on me for their financial support--the chldren are 5 yrs old and step son 16 yrs old.

    Interesting.

    I am curious how the consulate made you return to the US. Did they simply put you in custody and force you on a plane? I didn't know they could do that.

    Also, Russia does seem like a strange place to which to flee. Although Snowden has done it more recently; perhaps Russia is extradition-proof or something.

    Can you not work here, under probation, and support your family in Russia? Or perhaps your wife and children could join you here.

    Finally, if what you say can be proven, you do know that your parents can be prosecuted for helping you flee the country?

    I need a little clarification... It LOOKS like you're HERE, with NO passport, and NO way to leave the country. Then you ask later whether there's a point in returning. How's that???

    In any case, they're NOT gonna ASK you what you think should happen to you. They're gonna tell you.. For starters, you WILL serve your original sentence of 180 days in jail, then they'll tack on some more for absconding from justice. Why on earth you'd think you'd do LESS is beyond me.

    Yes, it appears that your new life is gonna go away. But, if you're here, and you run again, you're gonna wind up doing BIG time.

    If you're NOT here, and you're in Russia WITHOUT a passport, and THEY catch you, you may never be heard from again..

    Don't come back then you'll for sure have to do the time and at very least a year probation and if you leave again it will just keep repeating its all about money so as long as you're on paper they can extort you for all your worth... criminals are their only source of revenue with the country and economy fallen apart

    And without probation you will get a considerable larger jail setence that's if they let you over 6 months you'll have to go to prison with mandatory 2 years parole

    The issue you will not get a passport renewed and thus have no work permit, In act my guess is your Russian work visa is already revoked, once the embassy changed the classification of your visa and sent you out of the country.

    It would appear you had a warrant, and the embassy took you into custody, since once in the embassy, you are on US soil. So it does not envolve Russian government at that point.

    Yes, you will get jail time, they will sentence you to do the full time of your first sentence. So you will do jail time. I would not look at returning back to Russia, first now you will have the Felony conviction, on your record. ( I will assume you lied about it, to get your work visa in Russia, since they would not have issued it, if they had known)

    So not only will you do prison time, I doubt you can get a new work visa to return to Russia.
