    What are the chances of a stepchild(adult)getting insurance proceeds?
    My mother was married to my stepfather from 7/1969 until her death 2/02. (No will) of course my stepfather kept everything(no problem), he passed 03/13 no will, He had two insurance policies one naming my mother as beneficiary and one naming his parents as beneficiary, all beneficiaries are deceased, no siblings of stepfather and he had no biological children, I'm the only one left on either side. Insurance company sent me a letter saying to get order of administration to receive funds. My question is what are my chances to get this order, it does cost to get this order through probate and the policy amount is under $3000.00.

    The insurance goes to the person named in the policy.

    If they are dead, it may depend upon terms of the policy, if it then goes to the estate of dead person, or estate of the beneficiary.

    That is the only issue, if it goes to the estate of the beneficiary, then you will get it, if it goes to estate of the named insured, you will not.
