    Evidence before the SOL - ontario
    Am I correct in interpreting the SOL that I can only seek damages for the last 2 years, but I can introduce evidence from before the 2 year period to lay the groundwork for the case?

    You need to give us much more info before we can answer that. A SOL states the time limit you have to file suit (or get a criminal indictment). It has nothing to do with damages or anything else.

    Thank you for your response. I am asking for Ontario Canada courts.

    I own a property in common with someone who has had exclusive use for more than 2 years. Evidence from previous to that time shows that he excluded me from using it by a long drawn out campaign and I have reasons for not going to court at the time until now.

    As I understand it, I can only seek rent or replacement cost back for 2 years. Can I introduce evidence from before the 2 years to illustrate his tactics for excluding me from use?

    I don't see why you can't recover ANY AND ALL losses you suffered. What is giving you the understanding that you can only recover the last 2 years?

    There is no time limit on evidence as long as it meets the rules of evidence.

    Hello canadian person:

    To simplify your apparent confusion regarding the SOL. It pertains ONLY to the time limit wherein one can file suit. It does NOT limit damages, nor does it limit evidence. It limits ONE thing - the time to file the lawsuit - nothing else.
