    Help needed to get Divorce in India
    Dear Sir,

    I am living in Maryland, USA for last 4 years and holding green card(not US citizen as yet). I got married to my husband in India about 7 years back(in 2007) based on Hindu Marriage. At the time of Marriage he was on H1 Visa and we got green card in 2011. Things were not good from the first and later at the end of 2012 he physically abused me a lot and then I decided to move out of his house and living separately in USA. We have 3 year old Daughter from our marriage. She was born in 2011 July.


    Given that I am and my husband are Indian citizen and were married based on Hindu Marriage, should we take divorce in India or US. If I get Divorce in India Is that Valid in USA?

    Instead of pursuing divorce in US, can I pursue the divorce in India. Reason I want to pursue divorce in India is that Hindu marriage has different standards and adultery is considered much more serious in India as compared to US. I will have better chances of getting my Daughters custody in India as compared to US. Are there any repercussions.
    My only concern is my Daughters Custody, as I think he will only restrict there in order to still trouble me, as he knows that I love my Daughter a lot.

    How is it handled as this involves me as an Indian citizen and my daughter a US citizen which involves both countries?

    Please help and advise me on the situation.

    Your divorce is valid in any country regardless of which one you get it in.
    It isn't clear whether your husband is in agreement with you, both about getting a divorce, and about shared custody. If there are going to be disagreements, plan on getting divorced in whichever country you are willing to spend quite a long time in.
    It also isn't clear how you will prove adultery, especially long distance, if he denies it, which he probably will.
