Flight while on probation
I am on probation for 4th degree felony. Distribution of marijuana within 1000 ft of a school yard. Other charges were dropped. Probation for a year.
I just got arrested for driving drunk. It's a mini dui. Probo officer says it might not violate probation. Court date is on the 11th. I'm supposed to fly from NY LaGuardia to Atlanta, Georgia. I'll be there from thurs to sun December 5-8. I live in nj and am on probo in nj. Are they going to check and or notify my PO that I have:
1. Boarded a flight in another state.
2. Left the state and not returned for >24 hours.
What about getting back? I'm supposed to land Sunday at Newark nj airport. Does that pose a bigger risk for a violation?
My apologies if this is confusing. I need an answer tonight! Oh and I was denied travel permit because my po said his boss wouldn't let him give me one after the dui even though I still haven't been to court... All answers are appreciated.
Thanks in advance

Sorry to post again not sure if I can edit or not. I'm on my phone...
Forgot to include that I will have only cash on me, and I will not be using my cell phone at all in Georgia. I'm pretty sure I can use just my license for id to acquire the tickets. They were paid for by someone else so my credit or debit card was not used my name is simply on the ticket same with my girlfriend.
Please help! Don't want to disappoint her.. but I'd rather be sure than sit in jail for a month or longer and get resentenced

Hello pro:
Instead of putting your tit FURTHER into the ringer, I'd take another approach. First off, a travel permit is NOT a reward for good behavior, and CAN'T be used as a sanction for a violation you HAVEN'T been found guilty of.
If it were me, I'd make a SECOND travel permit request, in WRITING, sent CERTIFIED, return receipt requested, with copies sent to your po's supervisor, and his supervisor too. Send another one to the prosecutor and another one to the judge.
You're RIGHT... They're NOT gonna like that at all. So?
Certainly, if you had a COPY of the policies and procedures manual of the probation department, you'd be able to CITE the particular rule that I'm speaking about. In your letter, I'd ask for a copy. Yeah, that'll piss 'em off too.
So?
Please don't misunderstand... My advice is NOT aimed at pissing off your PO. It's aimed at you getting what you have a RIGHT to get. I can't help if that'll piss them off. It SHOULDN'T, but we know it WILL.

I'd like to do that, however I'm leaving tomorrow and I doubt I'll get anything returned by then. Am I wrong in this assumption?

I really want to know what the odds are of my PO finding out. He has no info whatsoever of departure times etc and I have read that he can't request such info from an airline. Can he find out if I left? Will he be notified?

Hello p:
If you take my approach, it won't get done by tomorrow.
You've painted yourself into a corner.. I don't think they'll catch you, but LOTS of unforeseen things could happen that'll ruin you.

My apologies for being so unorganized this is all so rushed. He's been on vacation for a in' week and a half and I haven't been able to get in contact until today. I should have asked a long time ago, but either way I'd be in the same situation with a rejected request for permission to leave. I'm more worried about security seeing the felony conviction in either Ny or Georgia. Even in nj. What will they do?

Hello again, p:
I have NO idea what those airport cops have on their computer screens. I'll bet it's more than Donkey Kong. I DOUBT they'll see that you're on probation, or if they'll care.
Look. You can't cover ALL possibilities... I dunno HOW he could find out, but he's a COP and they have strange ways about them. If it were ME, I wouldn't do it. What is it? A GIRL???? She'll WAIT, won't she? If it was for a job, or to tend to a funeral, then I'd say go.. But, for some nookie???? Dude!
