Hello everyone,

My wife and I rent a house in Minnesota (Dakota country) and for a long while we have allowed her friend (now former friend) to live with us, paying us a small sum twice a month. We have a verbal agreement but never made a written contract. We do have a proper written agreement with our landlord, but the friend is not mentioned on it.

This former friend suddenly stopped paying us to stay here, and is refusing to leave. We would like to kick her out, but don't want to involve the landlord, the police, or any authorities. We'd rather not do that in Minnesota in the winter since it's so cold, but she already owes us $400, and will likely continue to stay here as long as she possibly can, until we do something about it.

What are our options?

You do not have to involve the landlord since you are her landlord. You do not have to involve the police, since this is a civil, not criminal matter. But you DO have to involve the housing court system.

This person is your tenant, you are her landlord. You both have all the rights and responsibilities of a tenant/landlord respectively. This means you have to give her proper notice to vacate and if she refuses you then have to go to court for an eviction order.

To clarify a bit, OP is her landlord because, the agreement that the roommate would pay so much per month rent probably constitutes a sub-letting of the premises. She is OP's sub-tenant.
