OPT Student Starting 1099 Employment
Hi,
I'm going to get my EAD card on January 2014 and I'm already get a job offer. The company will hire me as an independent contractor however, and I'm not sure whether I should still fill the form even if I have stayed in the U.S. for less than 5 years (I came here from Indonesia in December 2009).
Also, is there any deductions from the tax once I submitted the form?

Since you are on OPT, working under Form 1099 or Form W-2 is irrelevant, because you will owe NO FICA or self-employment taxes.
However, filing the Schedule C WILL allow you to deduct some employee business expenses that cannot be deducted using Schedule A.

Thank you so much for your answer. But does this mean that I don't need to submit any form or do I still have to submit nonresident tax form?

You WILL have to submit Form 1040NR (non-resident return) with Schedule C to report the Form 1099 income.
