    Do I Have Cause to sue NYC Child Support
    A year and a half ago when applying for a passport (which I was denied) I was informed that I owed 64k dollars in child support. After fighting with an unresponsive child support system and many court dates later, it has finally been resolved as a case of mistaken identity (not mistaken paternity).
    My business & life have been damaged, my credit is screwed, still fighting to get my passport and drivers license un-suspended, my company can no longer get financing for my clients (self employed business consultant). I have a letter from NY State saying sorry for the inconvenience. Do I have any recourse here?

    I do see (by googling) mistaken identity cases across the US that have been won against gov't agencies.
    I personally would sue, after interviewing 2 or 3 lawyers.

    It all depends on negligence. If the agency was negligent in doing its research and made the mistaken identification as a result, then you have a case. If the mistake was reasonable, then no.

    On the other hand, cases like this are usually settled even when the lack of negligence is clear. So go ahead an consult an attorney.

    If you knew from first day, it was not you, what at that point was also your actions ? But yes I agree a law suit is possible, but they are not easy to win.
