    Is the deviation from code grandfathered? In other words, when the house was built (or the modification at issue installed), was it according to code at that time? In other words, it's possible that the house was built to code but the building code was changed after that time.

    I saw a seller lose a lawsuit once for undisclosed code violations even though he had paid the $300 fine for not filling out the required disclosure form (varies by state). The court felt that 'buyer beware' didn't apply to a naïve home buyer. I suppose it will vary by case.
