    Dui and warrants
    Hello, My friend just got stopped for something else minor and he had 1 warrant and 2 in another state for dui... and I was wondering how much time he would have to do in jail. I was told by a judge that I have to stay away from him and can not write or talk to him or I would get arrested.. we both got caught fighting in public and got taken in. but I had no previous records. I'm dying to find out how much time about he would have to do. Were from philadelphia. Thank you:o

    Well I'm guessing that a dui is 2 years and 3 warrants, so I'm guising that he is 5-6 years in jail.

    His relative said that when he called her it might be 18 months but she wasn't sure

    It will also depend if they let him serve the time all at the same time, ti is possible he will serve so much time in one jail, and then taken to another court to be sentenced there.

    Now looking back at your other answer, if part of your hearing the judge in your case has ordered you not to contact the other person this is a no contact order, and yes you could end up in jail yourself for contacting him

    It appears you have a judge in your case that cares for you and is trying to get you away from someone with varoius criminal records and a obvious drinking problem.

    But he is right most likely 18 months in one state and then most likely 18 to 24 months in the other state would be my guess

    So they would definitely check New Jersey for the other duis my uncle told me as soon as he gets out there is someone their to take him straight to jersey, is this true?

    When anyone is booked, arrested, or processed into jail, they run a criminal history ( NCIC) report that will show any prior arrests ( so they can help determine their security rating if they use one) and also to see if they are wanted in any place else, plus the aresting agency would have notified every place with a outstanding warrant that he was being arrested.

    It is up to that agency with the warrant to issue a hold to be put on him in the jail he is at. If they fail to issue a hold for him, then he would not be held. It will depend if the other state with a warrnt wants to pay to have him brought back or not. Normally when we had people released from jail if they had a warrant somewhere else, the hold order was put in place to hold them for the other state, giving them a certain amount of time to come get them.

    So jersey would have to pay philly for transporting a inmate didn't know that. Hopefully jersy is cheap!

    Yes that is why many people are not held on their outstanding warrants, esp minor ones, I guess we would stop several people a week in GA on out of state warrants, and the other state was not willing to come get them and pay the cost of it. So what happens after we stop them, if we are not going to arrest them for something ourself, the other state only has ( we gave them 30 min) to decide if they wanted them held or not.
    Long 30 min you and a suspect just sitting around with them hand cuffed just waiting to hear back from other state.
