    Child abandonment
    I'm recently divorced and got evicted... my ex knows I'm goung to live in Florida... can he try to take my children for full custody and take me to court for abandoning my children

    He's the other parent... his rights are equal to yours.

    The court is who gets to decide between the two of you based on the child's best interests. You each get to present your sides...

    You are saying that you were awarded primary physical custody in the divorce but later were evicted? Are you living on the street? Where are the children living? What do you mean "child abandonment"? It is possible that he could move to modify custody if you are no longer able to properly care for the children.

    The court of which state ruled on your divorce? That would be the state in which a modification of custody would have to be decided, at least unless your ex is no longer residing in that state.

    Not nearly enough info. What was the parenting plan in the divorce? Who got primary physical custody? What is the visitation schedule? Where are you now? Is your ex agreeing to your moving with the children? Or are you leaving them with him until you get settled in FL?
