    Child support hearing
    Its my 1st child support hearing I don't know if he is going to admit that my daughter is his or we need a paternity test but I just want to know what happens on the 1st court date?? Im sooosooo nervou.

    Are, or were, you married? The court may order a paternity test.

    Most likely a paternity test will be ordered before child support is issued.

    Is that all that will happen that day? The child support office doesn't say but do I have 2 have a lawyer?

    At this point a lawyer is not necessary.

    You will go in and be asked a series of questions by the judge, or magistrate depending on how your local judicial system works. He will be asked a series of questions.

    Child support will not be issued to a man who is not the biological father of a child. There is only one way to determine who is the biological father. ;)

    OK I know he is for sure that's not the problem its getting him to show up and if he doesn't what will happen?

    Has anyone asked for proof of income, has there been a request for a certain amount.

    First hearing can vary by how much and how many pre court motions have been filed.
    Personally I would never enter court without an attorney, what if he has one, and they make motions in court

    You know he is, but the court doesn't. They will require evidence, i.e. DNA, before they order support.

    If he doesn't show and was properly served, then the court may order support by default. Or they may postpone and issue a warrant or they may do something else. There are many options. So you show up, you don't need an attorney at this point. If he does show and denies paternity, then the hearing will be adjourned pending the results of a test.
