    Unless the dispute is connected with a pending lawsuit, you would first have to file as suit, before you could file a motion.

    A motion is to a lawsuit as a battle is to a war.

    To find out how, exactly to proceed, I suggest that you read up on civil procedure. Search for the Utah rules of civil procedure, &/or the statutes governing civil procedure (some states put procedure in rules and others put it in their statutes.)
