    Past Bankruptcy/Mobile Home Mortgage
    I filed for a bankruptcy two years ago and I listed my mobile home in paperwork. I didn't have a bankruptcy attorney because I didn't even have enough money for one. Now I am have to leave my mobile home. I have tried to get someone to assume the mortgage, but the company has turned down everyone because of their credit scores and job situations. I can't continue to pay for a home that is not even worth half its value, but for some reason the mortgage company is already calling me even though I didn't sign a reaffirmation agreement. At the time of bankruptcy I planned to keep the home, but I didn't sign an official agreement saying I would reaffirm the debt. I was sent one in the mail and I still have a copy of it. What should I do to handle this properly?:(

    Is the mobile home in a mobile home park? If so... do they allow rentals?

    I believe that you should be able to walk away from the mobile home without suffering any harm, provided that you DID NOT sign a reaffirmation agreement. You may wish to confirm this with an attorney just to be sure. Perhaps lisab, who is an attorney will see this post. Good luck.

    Yes, but renting is not an option and the property owner is OK with me walking away because he will buy the mobile home for half the price when it goes into foreclosure.

    Without knowing how the mobile home was not sold by the trustee at the bankruptcy if it was included in the bankrutpcy needs to be looked at, since if you did not re-affirm the debt you should have lost it at the Chapter 7 bankrutpcy.

    If it was re-affirmed ( although you were not aware of it in court by your actions) then you may not be able to just walk away.

    And was there a final discharge of the bankruptcy ? I will assume yes

    So really an attorney needs to review your bankrptcy paper work, and see exactly where the loan stands.
