Parole Violation in NJ
Hello:
Looking for some help. Husband was sent back to jail today for a parole violation. First time offense. Max release date original was 7/5/14. With the parole violation how long can he be there for. Can they send him back to state prison?
Please any advise would be helpful.

They can send him back to serve the entire rest of his sentence as he would have had on the day he got parole. Meaning that time n parole meant nothing.
But that's up to the Judge.

I appreciate the help. I really hope its not the full time as his parole office was allowing him to leave the state for school. Still trying to get info from his
PO about what happened.

That's just not true. It WOULD be true if he were on probation, but when he's on parole, his release date is sacrosanct.

He won't see a judge. He'll see the parole commission. But, if they arrested him, they plan to give him some time..

Agree with excon, he will go to the parole board ( commission) and his max date will still be his max date.
It may be one or two months to get a hearing,

The parole officer said he violated since he had alcohol in his system. Does that still mean he will get time?
