    New Jersey ITIN
    Hi,

    My Wife came on H4 last year.
    I am yet to file the Tax return with W-7 for my wife's ITIN.

    But what can I do to file the local NJ state tax as I would miss the deadline if I wait for the ITIN to come and file the local state tax.

    Please advise.

    If you have a refund coming from NJ, then WAIT for the ITIN before you file the NJ tax return. There is NO PENALTY for filing late if you owe no taxes.

    If you OWE taxes, file the tax return and PAY the taxes. Even if the return is rejected, the payment will have been made ON TIME, so no penalties will be due.
