I am in serious need of answers. I go to court tomorrow for vop, I had went once and my p/o said he was going to ask for continuous but when I got there someone was covering for him so I postponed it. Then I went 3 months ago and my p/o called the morning of and said he wasn't going to go and he would call and ask for 3 month postpondment since I started a new drug treatment prog and see how I would do. He keeps telling me I am not going to go to jail but this is my first time violating and I am scared. I have four months clean now, I am getting ready take my ged test, I filed papers for my children to get written custody agreement, (I still have joint custody but father only lets me see on his terms) I completed all the self help and I was only court ordered to stay in drug prog until jan 2013 but I choose to stay because I know I still need help but I have come along way and not just because of court. Can anyone help me with some answers. My charge was credit card scheme and I got 18 months and I only had to serve ten days. My prob ends jan 21 2014. Does judge usually go by what p/o asks for?

They weigh heavily on the recommendations of the PO... however other factors also come into play... such as their judgement. And if they have had a lot of parole / probation violations recently... they are likely to come down a lot harder.

And really there is no set in stone way they HAVE to deal with this... they might go easy.. they might come down hard... or anything in between.

What "usually" happens really has no bearing because the reality is every case is not identical.
