I am 26 yrs old and had to move in with my parents due to my arrest of battery and criminal trespassing. I was denied a public defender because I am currently staying with my parents who are not fully supporting me. How can I get a copy of my motion of discovery without a lawyer.

It, like a lot of questions here, depends on what state you are in. Most states have a set of criminal rules, and/or a code of criminal procedure. Those will tell you exactly what you need to do to engage in discovery.

I found a form online. And could you tell me if I have to file a form to enter evidence of my own. Or could I attach a cover sheet including the case number and names of both involved parties and have that mailed out to the D.A and court?

I have evidence of my case in which I have to represent myself and I need to know if there is a form that I need to file in order for that evidence to b heard in court.

Someone said, a person representing himself in a court case has a fool for an attorney. You need direction from someone familiar with court procedure. I would contact the court clerk where your hearing is to be held and ask them.

In a criminal case you are entitled to representation provided by the court. Even if you try to represent yourself, you can still use a court appointed attorney for advice.

Evidence has to be presented to the court and the prosecution prior to its use. It needs to be verified that it meets the rules of evidence. If it doesn't, the prosecution may object and the judge will hear arguments about the admissibility of the evidence.

We need to know your location. But at 26, you shouldn't be judged as to your eligibility based on your parent's income.

Each state has its own laws, Georgia for example often denies a public offender if you can afford bail. Others will use family income of the household you are living. The right to an attorney is not as perfect as it used to be, and with cut backs in funding, the ability to get one is getting harder

As several have noted, you really need a lawyer who knows what he or she is doing.

You prevously asked about discovery. That means finding out information about the case from the other side, not submitting evidence to the court. And in a criminal case, discovery is usually quite limited, especially for the defendant. You do not want to be spilling the beans to the prosecutor when, as is normally the case, you don't have to.

In other words, do not give any information to the prosecutor, and don't give any information to the court until the trial.
