How do I prevent my wife from selling our house without permission?
My wife and I seperated; she took everything and left me homeless by getting a bogus temporary restraining order (to give herself time to take all my belongings). I found out she was selling my tools, etc. on eBay. Now the house is up for sale and I'm sure she will cut me out of the profits. Can I get a property lien to stop her?

Are you on the deed? She can't sell without your signing the deed.

Why haven't you filed for divorce? Get a restraining order preventing her from disposing of any assets. If you find the listings on E-Bay, contact e-Bay and tell them she is not entitled to sell the items.

If she has obtained a TRO, there probably already is a divorce action pending.

    Good point.

So how did she get a TRO? Did you fight it? Did you at least ask for permission to remove your belongings. You should be able to go to the house with a police officer to remove your stuff.

Ebay will tell you to call the police. The police can contact eBay, and then eBay will take down any active listings and possibly the selling ID. They can't go back and collect for past sales.

In the off-chance OP's name is not on the title, yes, he should immediately record a lis pendens.

OP obviously needs an attorney. In many states, the court can order one spouse to pay for the other spouse's attorney. So talk to an attorney tomorrow.
