Is there more to this story? A father losing custody because of the age of the person he's dating (especially since the person is an adult) makes no sense.

There has to be more to this story.

I doubt seriously if a court would change custody just because a father was dating a younger woman as long as that woman was an adult.

Of course there may be other factors involved that could contribute. So I'm curious what prompted the question. Are you the father? Or what is your interest here?

Don't want the dating to affect his child custody

What makes you think it might? Has the mother made noises?

Sounds like the mother may be trying to stir up trouble. That is the first thing any Family Court judge would see. It would be up to the birth mother to prove to the court that it would be a bad environment for the kids.

The burden of proof will be on her. If your lady isn't a convicted murderer or out and out hooker, you will probably be just fine. Do the kids like her? That has a lot to do with it also. Mom is jealous.

Just by looking at the OPs username, I believe that the OP is the younger woman in question.

Yup. You are probably correct. Didn't notice that at first. Advice to "girlfriend" don't try to start any battles with Mom. Just let Dad take care of things and be supportive.

Dating won't change the custody/visitation arrangement - having sex in front of the child will. Otherwise the Court pretty much doesn't care.

The court will not care if you date, ( if you are in the US, it can even be someone of the same sex) the Court just does not care. If that person is dangerous, has a criminal history, or if that person has lost kids to state before, that matters.

But no, the age of person does not matter

Well first, the mother will have to initiate a court case. But the court will not care if you date. It is unlikely to care, even if you stay overnight or move in. The court will only care if the relationship harms the child.
