    Want to get custody
I have a question of my own about custody. I have always taken care of both my sons. My x (father of my sons didn't take care of them or pay any child support) got custody of my oldest son two and half years ago but he has been living with me the whole time I had custody and lost it because I could fight because I was/is in CA and He was born in OH. I had custody of him when I moved out here. I had to move because he came to my work my home and threaten me. I try getting a restraining order in Ohio where I did live but they didn't give it to me even though he said yes he came to my home work and threaten me. She didn't even tell him to stay way from me and He just laugh. I couldn't stay if I did I might not have been here for this boys. (He says the younger one isn't his) I live in CA for 4 years now. My oldest was autism and my youngest has PDD. So time just has pass so fast. Now I need custody of my oldest back. But how do I do that?

I have moved your question from here

If you have a new situation and questions, please start a new thread rather than add your question to an old thread, even if that old thread seems similar to yours.

If your ex still lives in Ohio, you will probably need to ask the Ohio court to modify the previous custody decree. Refer to the Uniform Child Custody Jurisdiction and Enforcement Act, which is the law in Ohio as well as California.

I'm confused. Your ex was awarded custody of your oldest, yet he has continued to live with you the whole time? Further, you moved from OH to CA with both your sons? And the father did nothing about it?

If that's the case, I wouldn't stir the waters by trying to get primary custody. If, I'm reading this wrong, please clarify.
