    Court for delinquent support
    Going to court really soon. The state is taking my child Father to court for 6 months delinquent child support plus 12 months of medical premium reimbursement plus the interest he owes the state. I have been remarried for 5 years and have sole conservator ship. My child's Father refuses to work and knows that my current husbands income and mine is more than enough for us to take care of our child therefore he refuses to help in anyway. He has not seen our Child in years and when he does he is very verbal with our child. The state will give him a time limit to pay and in any reference that he will not be able to, that is when they are going to offer him to sign over rights and not pay me medical or child support that he owes. It will save him almost 20,000. But I'm scared he won't sign over. Is there anything else I might need to do?

    There is nothing else you can do. I am confused by the conservator language. Where are you?

    Yes and the signing over of rights, I know of no state in the US, that would allow this. In most he would go to jail, lose drivers license or more.

    In US, you can not sign over rights to get out of child support. That is a myth.

    ANY question on law needs to include your general locale as laws vary by area.

    Why doesn't your husband file for adoption? That would have the same affect. And why wouldn't he sign? If it gets him out of his support obligation, it would seem in his best interests to sign.
