    Texas eviction process no lease
    I live in Texas. My son and his girlfriend moved into my house 7 months ago because they had no where else to go. They had been staying with her family, but have burned all of those bridges. I have never gotten along with this girl, she has 4 children with three different men and has never been married. None of the children live with them, they all live with different relatives of hers.
    When they moved in, I told them the only way the could live there was if they both worked. My son had a job for several months and then lost it because of this girl. She has not ever been employed making excuses the whole time. When I go home for lunch she is in bed asleep, When I get home in the evening at ^pm she is asleep. They both tell me they have been out looking for a job for her. My sone got a job a few weeks ago and works nights.
    Last month they did pay me $400 for rent, but I have been providing for them for 7 months. They finally got food stamps, which she sells so she can have some cash, but when they run out of food stamps, they eat my food, they use my toilet paper, paper towels, laundry detergent etc.
    I don't make much money myself, so hardly get by. Recently, I discovered that all of my good jewelry is missing. Including my husband and my wedding rings
    (I have been a widow for 20 years). Which was devastating to me. I have noticed other things missing too, but cannot prove anything.
    We do not have a lease, but I want them out! I wasn't sure if because I accepted the $400 do I have to evict them or can I just give them a 3 day notice to vacate?

    You have to evict them. Doesn't matter that they paid or didn't pay rent since, it was not regular enough to establish a pattern. So without a lease specifying a rental, you can't give them a pay or quit notice.

    So you need to give them a 30 day vacate notice. If they fail to vacate by the deadline, you go to court for an eviction order.
