If it's the other person's fault then the other perosn's insurance pays for your damages, not your mother's insurance. The fact that your license is expired doesn't really matter - the other driver's insurance should cover the repair costs to your mothers' car. Did the police investigate, and is there an accident report? If so, that will really help your case. Your mother should be sure to call her insurance company to report the accident, and again since it's the other person's fault her rates should not go up because of it. Normally in this situation your mother could work through her insurance company to be reimbursed by the other driver's insurance company (it's a free service that they provide that avoids a lot of hassles), but in this case because you were not licensed I suspect that your mother's insurance will probably not do this for her, since her insurance only covers legally licensed drivers. So she will have to contact the other driver's insurance company directly and file a claim, then start the negotiating process over who will do the repairs and whether OEM, after-market, or refurbished parts are used in the repair.

As noted, the other person's LIABILTY coverage should cover the repairs to mom's car. So you should submit a claim to their insurance carrier. You should also notify your mother's insurance carrier.

Now if the other carrier denies the claim your mother's collision coverage should cover repairs minus whatever deductible she has. As ebaines said, they probably won't because you were an unlicensed driver.

Bottom line is we can't answer this question because there are a number of factors to consider. But the definite way to proceed is put in the claim to their carrier, especially if you have a police report that cites the other driver for running a red.
