    Child support enforcement lawsuits
    My problem with Child Support Enforcement is this.. I filed for child support from my ex husband, and had been waiting for DCSE to collect from him. I was informed my case was on hold because he had filed for disability. On March 30 I received a letter from DCSE stating that my ex husband had passed away. I sat our son down and told him, which he took pretty hard. Three days later I sent an email to my ex husbands mother and expressed my condolences and she informs me that my ex husband is not dead. The date on the letter from DCSE was March 26, four days after the supposed death of my ex. My concern is for my son, and our family because the emotional turmoil this mistake has caused us. Isn't there a law or guidelines that need to be followed and verification of these things? My son, who already has emotional issues, is devastated, and I can't think how to tell him that it was all a lie. What can I do legally?

    In form collections that he is not dead, have them verify, and proceed with collections. It is possible there was a error in paper work, ** possible mother does not know ?

    While this is a tragic circumstances, I would think you would be happy to find out he's not deceased. Clerical errors happen all the time.

    If you are thinking you have a lawsuit against them, I doubt if you would win. It would most likely be thrown out of court. You would have to prove malice or negligence and that is unlikely.
