    Son taking over my home
    I am 59 and own the home completley and my son and grandson and pitbull has moved into a few months ago and I can't get him to leave and his excessivley drinking and anger moods makes me fear to push the issue, he has caused me to place my 95 yr old mother in a nursing home due to the emotinal pressure and stress he has caused in my home he hasn't paid one dime and has destroyed my home. I just want him out asap and allow me to bring my mother home so I can take care of her and have her life happy in the home she knows
    He claims I can't kick him out cause he has lived there more than 30 days and I can't make hime move
    Help me get my home back...

    Hello h:

    He's partially right.. You have to evict him just like he's a tenant. I don't know where you are but your state landlord/tenant laws are probably online. Generally, it begins with a written 30 day notice. If he doesn't go after 30 days, you can go to court to get an order of eviction...

    Or, on the other hand, if you're afraid of him, you can get an Order of Protection, which will force him to go NOW. It'll be served by a sheriff, so you'll have a modicum of protection. After that, if he comes within a certain distance of you, the cops will put him in jail, no if's, and's or but's.

    As excon said, you have two options here. But you say they moved in "a few months ago". Can you be specific? Was there any agreement for him to pay rent? When did you first tell him to leave? Do you live in a small town or larger? What is your general locale.

    Give us more info and we may be able to help more.
