    How will monthly payment amount for arrerages be determined if no court order
    My ex and I came to an agreement with child support and did not have to go before a judge. My attorney at the time never had the judge sign off on it and I find this out 6 years later when I went to DHS to enforce child support since he was not paying that I have no valid child support orders. Back then he was making $12/hr. Now because of his sever alcholism he can't even keep a job so is making nothing. What amount should a judge base the arrerages he owes me? Would he base the past 6 years on his current income of $0 or what he was making at the time we separated? How far back will they go on arrerages? I feel screwed over here because this was not my fault. It was the attorney that never did his job.

    I don't know what State or Country you are in - in my State, NY, you can only collect arrearages if there's a Court Order.

    If your Attorney made an error, that's who you should contact.
