    Difference between 1040 and 1040NR
    Can you explain the difference between forms 1040 and 1040NR?

    I have an H1B visa and was out of the country only on vacation (15 days in March and 10 in December). Which form should I file?

    Form 1040 is filed by residents and Form 1040NR is filed by nonresidents.

    To tell you what form you will file:
    When did you enter the U.S. and on what visa? Are you married? Did you file your 2006 tax return? If yes, which form?

    Hey,
    This is quite an old discussion. But if you still check it, I have a question.
    I am on F-1 visa here in US. I have been filing 1040 instead of 1040NR for past three years ( actually the accountant). Now I want to fix it. Can you please let me know how to do that? Also how much is the difference in tax return in both forms?

    You will need to file Form 1040X to amend the return, then attach a properly- completed Form 1040NR-EZ with Form 8843.

    Print the word "AMENDED" on the top of the Form 1040NR-EZ.

    Expect to pay additional tax and interest with each amendment, but you can ask for a waiver of penalties.
