Laws if one leaves the scene of an accident and comes back later to call police
I want to know what are the laws if someone who is involved in an accident leaves the scene of the accident before police arrive and then comes back later, after they have run their errand, and files a police report. The other party left after the second party never returned. No info was exchanged. It was stated to the insurance co that the second party left before the police arrived but they paid the claim anyway. Now they are trying to chrge the first party with leaving the scene of an accident. They did leave only after the second party never returned. The accident happened in Dekalb County in Atlanta, GA. Nothing has happened to the second party. No charges were filed for leaving the scene and they got their auto repaired. I do not believe that this was handled properly and want to know what if anything can be done. The first party has a public defender who is trying to get them to plead out and let the matter rest. In other words, the second party did nothing wrong.
