    Can I sue dcfs
    My 2yr old and my 3month old were removed on allegations of neglect. I do whaf they ask and the father goes with me to class evem though not court ordered. My & my csw bump heads because I want my kids back. My newborn is in foster care & 2 yr old with my mom. My 2yr old was removed from my moms with out court order after being there for 5 months.with no reason. My workr got mad because I said I was going to record and post video of how my son cries when I leave from visit. So my csw went and picked up my son and moved him 2 hours away with out even a phone call to me.. I met with her supervisor and they didn't know that.. they made her return him to my moms. She was supposed to have him back by 8pm yet she got to my moms 12am I feel she endangered my son and did it to get back at me for me talking to her boss. The father is non offender and she brought more allegations of domestic violence. He could have had the kids he was granted discression yet my kids are still not back after 5months. She never returns my phone calls. It took 4 days for her to call about removal of mh 2 yr old. I have 6 family members who passed fingerprints yet my baby is in foster care..

    So what is your attorney that is presenting your facts to DCFS says about this?

    It appears they had a reason to remove and you must prove to court evidence that issue is fixed. Merely wanting the child back is not enough, bad mothers often want the child back.

    So what were you doing wrong ? Why are you having to take classes ?

    Anyone can sue over anything. The question is can you win. In most cases suing a govt agency is an exercise in futility.

    You should be talking to the supervisor to get a new caseworker assigned, but I doubt if a suit would be viable.
