    Rental lease default
    The tenant has not paid rent for 3 months, violated the lease by sub-letting the property to a third person, allowed children on the property and has had insufficeint funds to pay rent for mutliple months

    The property is in Plant City so what is the process for termination.

    You file for eviction... you have ethem served according to your state law... (2 weeks in FLordia, 30 days in most of the country.. 60 days in parts of California) (I have no idea where Plant county is) if they have not vacated in that time you file with the court to enfore the eviction where the sherrifs will put them out and then you change the locks.

    Why did you wait 3 months. As soon as they were late you should have given a pay or quit notice.

    You have to give them a written notice. The type of notice depends on the basis that you want to use to get them out.

    If you want to get them out based on non-payment of rent then you have to give them a pay or quit notice. The time for that notice depends on the laws of your state. Tell us what state the property is in and we'll tell you the proper time. If they don't pay the full amount within that time then you have to file a lawsuit for eviction.

    Another basis you can use to get them out is violation of the terms of the lease. In that case you have to give them a notice that they must cure the violation within a certain time. This time also depends on the laws of your state. In this case, if they remove the sub-tenant and children from the property within that time then you won't be able to file a lawsuit for eviction.
