    Multiple H1-B visa
    Hello Gentlepersons;

    I was working for company A on my H1-B visa till Jan 31, 2007. I filed the paperwork to transfer my H1-B visa from Company A to Company B. My petition was received by BCIS on Feb 01,2007. This makes me to work legally with Company B as of Feb 01,2007. My petition is still pending & I have received another job offer from Company C. Company C is will to aplly for my second H1-B visa.

    My question is how will I justify working for two companies at the same time. I believe one has to be full time & one to be part time. Can I decide which should be full time & which has to be part time. Can I switch back and forth from part time to full time or vice versa.

    Do I have to notify BCIS each time while switching between part time/full time with Company B or Company C.

    Just for more clarification Company B & Company C are sister companies & they are very flexible at their end.

    As per law you should have multiple h1bs to work with multiple organization. It is up to you and your company to fix the terms on number of working hours. Only thing you and your company needs to take care is generate the paystubs without any gap. The moment any organization stops generating paystub for you that particular h1b becomes void.

    If am laid off from a job that got me H1 but my H1 visa still has 2 years, aand I get a new job three months later, am I in status or out of status.

    A US employer may petition for a part-time H-1B for you. As long as your work hours are at least 50% of the normal full time hours in your industry and you satisfy all other requirements for an H-1B, you are eligible to possess part-time H-1B status.

    If you have H-1B status already, you can apply for a concurrent H-1B for another part-time job. In this situation, there is no set number of hours that the beneficiary must work for each employer. You should ask the new prospective employer to apply for a part time H-1B visa on your behalf. You may keep two or more concurrent H-1Bs.

    You can apply for multiple H-1B’s. You are allowed to work for more than one U.S. employer, but must have an I-129 (Petition for Non-immigrant worker) filed by each employer.

    As long as you are in H-1B status and have been counted against the H-1B quota in the past six years, your petition to work for another employer concurrently is not subject to the cap.
