    Collection agency and statute of limitations
    I need some help please.

    I have been contacted by a collection agency trying to collect on a debt 9 years ago with ICBC regarding some vehicle insurance. I was also contacted approx. 7 years ago by another collections agency for the same reason and I did send them numerous post dated cheques to clear this account. The collections agency present is telling me that ICBC has no records that I already paid to a collection agency several years ago. I also have no records as I am currently in a high conflict divorce and either the other half has all personal records from back then or they have been destroyed. I have explained this to the collection agency and now they are telling me I need to provide them proof of this when I can't. I aksed them why ICBC would not have a record of this. The reply was its not their problem, its yours. The guy was really ignorant and I have already cited Statute of Limitations to him. He says he will continue to phone me and will not leave me alone although I have asked to not contact me again. He says the statute of limitations does not apply in this case. I do not believe him.

    Tell him by phone and by certified mail that you refute the debt and they may not call you again. All communication must be in writing. Do not under any circumstance agree to any settlement or your statute reopens.
