    Confused, new to old debt from who knows where
    Hi, am brand new to the whole process as well as this site.
    I received a letter dated 3/8/07 from a lawyer stating that HE had previously sent ME a debt validation letter, offered to bring down my original debt of $16,000. To $13,000. If I responded with payment by 3/22/07. At the very end of the letter was stated that "this debt my have been disputed". The only reference to who or what the debt may have been was: RE First resolution investment corp acct#xxxxxxxx.

    OK... First of all this letter was sent to me in my married name, I was divorced in 1991 and have resumed using my maided name ever since. I think I would remember having a debt of $16,000! Anyhow, after the shock of all this, I went on line and found out what debt validation is an what it can do for me. I did check my credit reports, nothing unusual there, and made copies. I sent a debt validation letter to the lawyer, (I never received one from him as stated in his letter) certified mail w/return receipt request.

    I have a few questions that I hope can be answered while I await a response from the debt validation letter I sent.

    1. Is it a practice of the person pursuing collection of the debt to sent the debtor a letter of validation? I thought the debtor was the one who would be asking for validation.

    2. What does it mean that " this debt may have been disputed"? I sure didn't dispute it, I don't even know what it is for yet.

    3. What are the statue of limitations for (what I am guessing this is) re-sold debt?

    4. I live in the state of Hawaii and the statue of limitations is supposed to be 6yrs. Now, can this lawyer actually sue or get some money out of me if he bought this debt?

    5. Can anything be done to me unless he has the original copy of my contract with who ever this debt is with?

    I faced something similar, a "lawyer" sent me a letter saying I owed a client money. It ended up being a small collection agency that bought the right to collect an old debt, I never paid and got them in trouble for representing a lawyer.

    If the debt is from 1991 then they can't take you to court but they can send all the letters they want, worded however they want. Don't worry, they can't sue you. I would just respond and say your not aware of any debt of this amount from 1991 and refuse to pay, they will send a few letters and then forget about it when its obvious you won't pay.

    Thanks for your reply. I am not even sure this debt is from 1991 or when, but the lawyer is real. He practices law in the sate of Hawaii where I live. I am waiting to hear his reply to the debt validation letter I sent to Him.
