    Theft of a trailer
    On Sept 24th this year a guy drove on to my yard while I wasn't here and took a trailer off my yard.He did some transport work for me after June 2010 and have asked him for delivery tickets or weighbrige tickets ever since but I have had nothing.Invoices he provided were added up wrong and he won't replace them.I have paid him £1950 and he says that I still owe him £1293.Because he has not given me the tickets for these loads I cannot claim back from the council 30% of the value of the weighbridge tickets as I recycle cardboard and plastic.As I cannot get the tickets from him I am losing £3960.I have dealt with the police they say it is civil how can it be civil when someone drives on to your property
    and take items thjat did not belong to me as I now trade as a ltd company but was not ltd at the time of the dispute.The trailer belongs to the ltd company and
    the items in the back of the trailer belongs to someone else and he has said that he will sell the trailer.Everyone that I have spoken to including solicitors,MP say it is definitely theft.

    When the police decide something is civil rather than criminal, there's not much you can do except sue the person who stole your trailer. Did you have a license plate on it?

    Hi,Yes the trailer had M.O.T. on it until March and was bought by the limited company 5 weeks before it was taken. He no longer trades in the same name asa he did then in fact he doesn't trade at all as everything is in his girlfriends name.Am I right in saying that you are telling me if you owe money anyone can come on your propertyu and help themselves

    NO, he cannot go on your property if you owe him money! But I have a feeling you told the story to the police with too much information. You should have just said you know who stole it. Now they say it's a civil matter because there's a debt involved - but they are wrong. It's just that it's almost impossible to get them to say they are wrong. You can try going to the captain. Be careful WHAT you say.

    I understand what you are saying but I had no choice because he said in a txt to me that he had informed the police and he had taken the trailer in lew of payment

    So you have to file suit. I would also sue him fro trespassing.

    There so much more to this.The second invoice he gave me was dated 20/2/11
    But I didn't receive it until 22/5/12.So I checked with H.M.Customs about V.A.T.
    And they said you cannot claim against that invoice because the V.A.T. Reg No is no longer valid.He has stolen this trailer but it doesn't belong to me nor does the skips and items in the trailer.Im very grateful for your replies.
