    This is something the executor takes care of. If you are the executor, I suggest you call the local probate register to find out what the method is for your state, as methods vary. In some states the executor petitions the court for approval to distribute real estate to the heir(s), and that court order is recorded with the register of deeds in the county. In other states the property passes via probate just as any other asset - a copy of the death certificate and letters testimentary is all that may be needed to be shown to the register of deeds. All this presupposes that any outstanding mortgages, loans, or real estate taxes have been settled.
