    Patient privacy breached?
    Ok.. I have medical records at local hospital.. there is a lady that works in billing there.. I think she has got into my records to get my address as well as other medical information on me.. which I haven't been to that hospital in a while so there should b no need for anyone to b accessing my records.. is there a way to find out if she has? And if so isn't that a violation of my privacy?

    What makes you think she has? If she accessed your records without permission, it is a violation. But you need to have more to go on.

    A worker at a hospital can access patient information, as long as they do not divulge any confidential information as social insurance numbers, hospital numbers, etc. Workers in the accounting section would possibly have to do this to get addresses and phone numbers for bill payments.

    If you know the person's name call her, which is the best way to find out what is going on. How do you know she has your address? Have you had mail from that hospital?

    As of now, it is not a HIPAA violation.

    Not quite. An employee can only access records they need to access in the performance of their duties. If the OP does not have an outstanding balance due, then I see no reason for a billing clerk to access the records.

    No mail from hospital... however I got an anonymous letter and mail from her about some stuff.. she did put her number on letter so I called it... so I don't really no her... she has been talking to my exor was... lets just say she defines crazy! So now she has my number and knows stuff about my medical history that he didn't tell her.. so I don't know any other way she could no this stuff other than accessing my records

    No balance due.. and like I said haven't been there since before he meet her so there would b no need to get into my files... I worked @ a Dr office for awhile... and I no when we accessed records back then each person had their own log in.. I assume that was to track what u was accessing... is that correct?

    So send a copy of the letter to the hospital and report it. They can usually determine who access records when.

    Well letter didn't have to do about hospital... I no confusing... she was giving me info on my ex.. did I say she defines crazy? Lol... it just kind of bothers me if she is using my personal records to play the games "

    Oops... just was kind of wanting to no if she could do that and if there was a way to find out if she was n my records

    The only way you will find out if she accessed your records is by reporting it to the hospital HR department.

    Again, no hospital employee can access patient records without authorization or the need to know. This is a violation of HIPAA. Your only recourse however is to report it.

    Ok thank u! Just want her to b held accountable if she is misusing her resources...
